“An attorney representing multiple landowners in the path of a proposed carbon pipeline says the company's South Dakota application for a permit should be thrown out. The filing with the South Dakota Public Utilities Commission by attorney Brian Jorde is in response to a request from Summit Carbon Solutions for more time for its permit to be processed.

“The company seeking a state permit to build a carbon dioxide pipeline through eastern South Dakota hasn’t yet filed a final route plan. And that’s raised uncertainty for landowners along it who aren’t sure whether their properties are within the 10 miles distance that would allow them to intervene,” KELO reports. “…Omaha, Nebraska, lawyer Brian Jorde represents many of the landowners along the route. Jorde filed a motion Thursday calling for the commission to keep the period open for landowners to intervene for 60 days after the commission receives the final map. “We simply have no idea of what’s being permitted or what the request is,” Jorde told the commission. “The starting point is, what’s the route? We don’t know.”

The main trunk of Summit's Midwest Carbon Express pipeline is planned to run from Iowa through South Dakota to western North Dakota, where liquid carbon dioxide can be pumped underground for permanent storage. The prospect of eminent domain has prompted filings with the Iowa Utilities Board.

“Iowa landowners are uniting to defend themselves against the use of eminent domain. The newly formed Iowa Easement Team wants to stop Summit Carbon Solutions and Navigator CO2 Ventures from using eminent domain to build pipelines throughout Iowa. Hundreds of farmers in the path of the recently proposed carbon capture and sequestration (CCS) pipelines have jointly hired the Omaha-based Domina Law to lead their legal effort.”

“For now, McPherson County does not want any pipeline carrying hazardous material to be built in the county. Sid Feickert, a county commissioner, said the county’s planning and zoning board and county commission board in January both approved a moratorium on pipelines carrying hazardous material. While Feickert said that would include oil and other materials, the moratorium was passed as a developer plans to build a carbon dioxide pipeline in the county.”
